SASS submission - Review of the Law Relating to Self-Defence

SASS provided comment to the Tasmanian Law Reform Institute's review of the law relating to self-defence. 

SASS supports reform to the current law of self-defence in order to more comprehensively address the needs of defendants who act in self-defence within a context of family violence.

We made a number of comments, including recommending reform to the criminal law in Tasmania to specify that imminence is not necessary where self-defence is raised in the context of family violence - an approach which is significantly more consistent with the nature of family violence. We also recommended that reforms be made to the criminal law in Tasmania to provide for jury direction where self-defence is raised in the context of family violence; and emphasised the importance of ongoing professional development in this area for the legal and judicial sector.
