SASS Submission - Discussion Paper: Section 194K of the Evidence Act 2001

10 May 2019

SASS has provided feedback to the Tasmanian Government on their Discussion Paper on s194K of the Evidence Act 2001. S194K prohibits the publication of a victim’s name or any identifying details in cases of sexual assault. Whilst SASS appreciates the original intent of this provision to protect the anonymity of complainants in sexual offence proceedings, we do hold concerns that the provision denies survivors of sexual violence the choice to identify themselves should they wish to do so. SASS therefore recommends a series of reforms to law, which we discuss in our submission.
